FB TERMS and CONDITIONS

By making a purchase (PHONE, WEB, EMAIL ECT) With Freedom Breeder you are
agreeing to the following terms and condition.

If you are not completely satisfied with your purchase or any item you
receive is defective, you may return it unused and in its original
packaging. Please contact us for return instructions before sending any items back. We CANNOT accept returns on used items, or items damaged by recipient. Customer is obligated to pay return shipping. We will promptly
refund your purchase price upon receipt of returned items if they meet all
standards for a return. Shipping and Handling CANNOT be refunded under any circumstances.

If a shipment is damaged during transit, you MUST note it with the freight service representative before signing, or refuse it at the time of delivery. Photographs must be taken of any damage(s) incurred during shipment immediately upon receipt and all packaging must be retained as evidence until any necessary claims have been filed with the shipping
company and resolved. Refund or replacement of any rack system damaged
during transport will be at the discretion of Freedom Breeder.
If any product is damaged in transit and is neither refused, nor inspected and
noted by a representative of the freight service, Customer forfeits their right to any claim for refund or replacement.

Any charges incurred for Other Freight Services must be paid by customer.
These may include but are not limited to, fuel surcharges, lift-gate operations, or any other ancillary services offered by the freight service that were not request at the time the shipment was booked.

If you need to cancel your order, it must be done prior to shipping. Once
your order has shipped, it is non-refundable unless it arrives damaged or
does not include the item(s) ordered. If your order does arrive with any
damage, please contact us IMMEDIATELY. All sales are final on custom
orders, no returns or order cancelation will be allowed on custom orders.

Product delivery schedules are based upon current production capacities, material or component availability, and inventory, and may be changed by Company as
conditions require.

The prices specified by Freedom breeder are subject to change
without notice, to Freedom Breeder prices in effect at the time of each
shipment of Products or performance of Services. Additional charges
may be applied for product modification or engineering services. Oral
Prices specified by any representative of Freedom Breeder are null and void.
Company reserves the right to change without notice the design of, or
the process of manufacturing, the Products covered by this Agreement;
provided that the foregoing will not be construed as relieving Company from its obligation to deliver Products which conform to the
specifications which Company may have furnished to Customer.

Our prices do not include freight, handling fees, taxes, and/or duties, and
are subject to correction or change without notice.

Pricing and terms and conditions may change at any time without notice.

Export orders may be subject to other special pricing.

All taxes, customs and duty fees are the purchaser’s responsibility

Customer is responsible for payment of all applicable state and local taxes,
or for providing a valid sales tax exemption certificate. When placing an
order, customer shall indicate which product(s) is/are tax exempt.

Freedom Breeder reserves the right to deny any changes to orders, which have been previously acknowledged by Freedom Breeder.

This Agreement and any disputes or controversies arising hereunder
will be governed by and construed according to the internal laws of the
State of California, United States of America, without regard to its
conflict of law principles,

Jurisdiction and venue with respect to any action, proceeding, or suit in
connection with this agreement will reside in the courts of the State of California.
Customer agrees to pay for all expenses (including attorney’s fees) incurred by
Freedom Breeder in enforcing the obligations of Company under this agreement.
